Short. Honest. Pakistani law. No imported US legalese. Aapke liye plain English mein.

The whole thing in 30 seconds
  • You use Tijarat AI to run your WhatsApp store. We provide the AI agent, dashboard, and infrastructure.
  • Your store, your customers, your data — always. We are the toolmaker, not the owner.
  • You pay monthly. Cancel anytime from the dashboard. No locked contracts.
  • Don't sell illegal stuff. Don't spam. Don't abuse customers. We will terminate you for it.
  • If something breaks, our maximum liability is the fees you paid us in the last 6 months. Be reasonable, we will be too.
  • Disputes go through arbitration in Islamabad under Pakistani law.

Who we are

Tijarat AI ("we", "us") is a software platform that lets Pakistani merchants run their store on WhatsApp using an AI agent. The platform is currently operated by Malik Imran Ahmed, a sole proprietor based in Tarnol, Islamabad, Pakistan, with SECP private-limited incorporation in progress. Day-to-day operations — support, engineering, and merchant onboarding — are handled by Rehan, the founder; your legal counterpart for this agreement is Malik Imran Ahmed.

We tell you this up front because most SaaS Terms hide behind "We are XYZ (Pvt) Ltd" even when no such company exists yet. We will update this section the day our incorporation certificate is issued. Until then, your contract is with Malik Imran Ahmed personally, doing business as Tijarat AI.

Accepting these terms

By creating an account or using Tijarat AI in any way, you agree to these terms. If you don't agree, please don't use the service.

You also confirm that:

  • You are at least 18 years old
  • You have the authority to bind your business to this agreement
  • You are using Tijarat AI for a real, lawful Pakistani business
  • The information you give us is true and current

Your account

One account per business. If you operate three brands, that's three accounts. Don't share your password — every action under your account is treated as your action. If you suspect someone got in, email support@tijarat.org.pk immediately and we will lock the account while we investigate.

Creating duplicate accounts to dodge plan limits or to evade a previous termination is grounds for permanent ban across all your accounts and businesses.

What our AI does on your behalf

Tijarat AI includes an AI agent that reads customer WhatsApp messages and can reply, recommend products, and book orders on your behalf from your connected WhatsApp Business number. You need to know exactly what that means before you trust us with your customers.

By turning the AI on, you authorise it to:

  • Read incoming WhatsApp messages on the number you connected
  • Reply in Roman Urdu, Urdu, or English based on the customer message
  • Recommend products from your catalogue at prices you set
  • Book confirmed COD or prepaid orders into your dashboard
  • Apply discount codes only up to the maximum percentage you configure
  • Hand the conversation back to you whenever you reply manually

The AI will never:

  • Promise delivery dates without your courier integration confirming it
  • Give discounts above the cap you set in Settings → AI
  • Charge a customer outside your approved payment methods
  • Continue replying after you start typing in the conversation manually

You remain legally responsible for what your store says and sells. The AI is your tool, not your scapegoat. Review the AI persona settings before you go live — and audit the conversation log regularly.

Your data — and your customers' data

Everything you upload — products, prices, customer phone numbers, order history, conversation logs — belongs to you. We are the processor; you are the controller. You can export it as CSV from your dashboard at any time.

Your customers' personal data (names, phone numbers, addresses) is held by us strictly to operate the service you asked us to provide. We do not sell it. We do not share it with other merchants. We do not use it to train third-party AI models. The full details are in our Privacy Policy.

One exception: anonymised, hashed fraud signals (a phone hash + a risk score, never a name or full number) are shared into our cross-merchant fraud network so that if a known fraudster hits another Pakistani merchant, you are warned. You can opt out from Settings → Privacy, but we strongly recommend leaving it on — it is one of the main reasons Tijarat AI exists.

How you pay

  • JazzCash, EasyPaisa, or any major card
  • Subscription auto-renews monthly
  • You can cancel anytime from Settings → Billing
  • Cancellation stops the next renewal — current month stays active

If payment fails

  • We retry the payment twice over 3 days
  • You get email + WhatsApp reminders
  • Account suspends on day 7 (your data is safe)
  • Account deletes on day 30 if no payment received

Refunds

14-day full refund on your first paid month

If Tijarat AI doesn't deliver value in the first 14 days of your first paid month, email support@tijarat.org.pk and we will refund the full amount, no interrogation. Founder honors this personally.

What we don't refund

  • Months after your first month (cancel anytime — but past months are not refundable)
  • Mid-cycle partial refunds
  • Payment-processor fees charged by JazzCash, EasyPaisa, or Stripe
  • Custom setup work agreed in writing

Refunds processed within 7–14 business days back to the original payment method.

Acceptable use

Tijarat AI is built for honest Pakistani commerce. The following will get your account terminated and may be reported to FIA Cybercrime Wing under the Prevention of Electronic Crimes Act 2016 (PECA):

Selling counterfeit, smuggled, or stolen goods
Selling unregistered medicines or supplements (DRAP violations)
Selling weapons, ammunition, or controlled substances
Selling adult content or anything prohibited under PECA
Spamming WhatsApp users who never opted in
Phishing, scams, or impersonating other brands
Pyramid schemes, MLM, or "guaranteed return" investments
Reverse-engineering or scraping our platform
Bypassing rate limits or abusing our AI
Anything that violates Meta's WhatsApp Business policy

We take WhatsApp policy violations seriously because if your number gets banned, you lose your storefront. We monitor outgoing volume and will warn you before Meta does.

WhatsApp & Meta dependency

Tijarat AI operates on top of Meta's WhatsApp Business Platform. Your use of Tijarat AI is also bound by Meta's WhatsApp Business Policy.

We can't guarantee that Meta won't change their policy, pricing, or your number's status. If Meta suspends your WhatsApp Business number, we will help you appeal — but the final decision is theirs, not ours.

Uptime & liability

We target 99.5% monthly uptime. We don't yet publish an SLA with credit refunds because we are pre-revenue and want to be honest about what we can guarantee today. We will introduce a paid SLA once we have a 6-month uptime track record to stand on.

Things we are not liable for:

  • Lost sales from WhatsApp outages or Meta policy changes
  • Lost sales from courier (TCS, Leopards, etc.) failures
  • Payment processor downtime (JazzCash, EasyPaisa, Stripe)
  • Indirect or consequential damages
  • Anything caused by your own misconfiguration of the AI agent

Maximum liability cap

In all cases, our total liability is capped at the total fees you paid Tijarat AI in the 6 months before the claim arose. This is a deliberately founder-realistic cap. If you need a higher cap, we can negotiate it in a custom enterprise contract.

Ending the relationship

You can leave

  • Cancel anytime in Settings → Billing
  • Export your data as CSV before you go
  • Access stays active until end of paid month
  • No exit fees, no claw-backs

We can end the relationship

  • You violate the acceptable-use rules above
  • You haven't paid for 30+ days
  • You attempt to defraud our platform
  • A court order or PECA enforcement requires it

Disputes & governing law

Step 1 — Talk to us first. Email hello@tijarat.org.pk and give us 30 days to resolve the issue. Most things settle here.

Step 2 — Arbitration. If we can't agree, the matter goes to a single arbitrator in Islamabad under the Arbitration Act, 1940 (read with the Recognition and Enforcement Act, 2011 where applicable). The arbitration will be in English and the arbitrator's decision is final and binding.

Governing law. These terms are governed by the laws of the Islamic Republic of Pakistan. For matters that cannot be arbitrated (e.g., criminal complaints under PECA 2016), courts in Islamabad Capital Territory have jurisdiction.

Consumer-protection rights you have under provincial consumer-protection laws (e.g., Punjab Consumer Protection Act 2005) are not waived by these terms.

Changes to these terms

We may update these terms as Tijarat AI grows. For material changes (price increases on existing plans, new data-use clauses, or anything that meaningfully reduces your rights) we will email you 30 days in advance and post a notice in the dashboard.

Founding-cohort price-lock is exempt from this — your locked Rs. 4,999/month rate cannot be raised by an update.
